Due to frustration and lack of communication from a business associate I initiated a small claim application against said individual but did not advise them in writing before hand - I did enter into mediation and have looked repeatedly to resolve the problem but said individual want enter in negotiation and has asked for my complication to be thrown out on the grounds that Pre Court Protocol was not followed?

Our hearing is booked for the end of Oct and my claim is based on an abuse of trust - I have never been to court before and my claim is entered in good faith - all other protocol has been followed accept an initial letter advising of my intention to initiate a claim - will it be thrown out by the judge on the day

Ok - then it is. The claim wont be struck out because you didnt write to him first.

So you dont need to worry about that. It may be you dont get the claim issue cost, but the claim wont be thrown out.

Well that's good to know - just feeling nervous - any tips for my bundle which I need to submit before next Friday 7th Oct

Just make sure its clear, paginated and you include an index at the front so the Judge knows what he is looking at
