Our daughter disputed a taxi fair last night the driver became abusive and frightening and she stepped out of the taxi. He then called the police to accuse her of refusing to pay. This wasn't the case she has sufficient means to pay and offered to do so giving the police three cards but they said she had to do it but she didn't want to face the driver again as she was frightened she was then put in a police van and has spent a night in custody and is currently awaiting interview once a solicitor arrives. She didn't run away, she had the means to pay she got out of the taxi because of his abusive nature, it was late at night and she was on her own and he didn't like the fact that she questioned his fare ... could you please advise what might happen? Thank you.

are they holding her for non payment of the fare?

we believe they are she has not been interviewed yet.

OK. I'm not sure what you are asking?

If you are asking if she will be charged or cautioned then probably she will.

If she got out of the taxi without paying then that is the basis of making off with payment.

It depends really whether or not she is believed on the point of her intention to pay. She seems to accept not intending to pay some of it.

If it just a conventional contractual dispute then she has a defence but obviously the police might not accept that.

Jo, not sure if you will get this but they have released her without any further action .. the Solicitor said exactly what you did and not to accept a caution but they didn't take it any further, she just has to pay the taxi driver and they are going to tell him not to be unreasonable about waiting charges.
