We own a house that was built on land acquired in 1955 from a private individual who passed away many years ago.
There is a covenant that says "The Purchaser shall not erect or bring upon or permit to be upon the land any swing roundabout caravan hut on wheels or any other erection or vehicle designed for human occupation other than the detached dwelling aforesaid"
We would like to keep a motorhome on our drive, and we know our next door neighbor will not be happy about this, would she have a legal case to stop us, especially considering she has sold some of her land and a house has been built on it, and the deeds state "There shall not be erected on said land any building other than one detached dwellinghouse.."
As the covenant was between the original purchase and private individual who died many years ago and who's house is now under ownership of a unrelated family, is there any case for enforcement? And if so who could bring that case.
