We brought 700 tents that cost £28000 from Germany that have a design fault.
We are trying to return them and get a refund but the company are not compiling...please help

How did you pay for them?
When did you get delivered and when was the fault discovered?

We paid via bank transfer
They were delivered in June 2016 but we didn't open or use them until August 2016. The first time we used them was for an event we had organised. We sold the tents to our guests as 'pre-pitched tents' so they effectively rented them from us.
As we were setting them up, they were collapsing within minutes of erecting them. We spent the whole weekend dealing with our very angry guests who repeatedly had their tents collapse on them and we were doing everything we could to repair them and reinforce their strength with extra string.
We discovered the fault lies in the joints on the poles which are incredibly weak. To make matters worse, the guy ropes are in the wrong position and when they are pulled out they put pressure on the weak joint and cause it to bend and collapse.
We have had hundreds of complaints about the tents and they have almost cost us our reputation!
We have tried to request a refund from the supplier in Germany or a replacement with new tents but they are refusing even they have admitted the tents are covered by a EU 2 year guarantee!

You need to write and set out your losses and request a refund within 14 days or say you will go to Court within 14 days. You should make sure you send this signed delivery and keep a copy.

If they do not refund you then you can issue proceedings in the County Court. You can either do this online at: or by completing form N1 and take it to your local County Court.

The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.

If the claim is for £10,000 or less it will be a small claim so you will not need legal representation. Over this value you would need representation for trial.

However given the claim is this amount you may not be able to bring the full claim in the UK. However if you do get Judgment you can get a European Enforcement order to send in bailiffs etc in Germany
