I disputed an item in the bill of costs because the other party did not show a fee note and evidence of dibursements. Unknown to me he had actually sent the fee note to a defective email address so that whilst I kept writing to him I got no reply but the court had the evidence. I asked for a detailed assessment under CPR 47 and the costs officer upheld the item, but agreed that II should have been served. He therefore did not award costs against me. The other party still continued not to show the evidence to me so I have appealed. This appeal is listed for a few weeks for 30mins. Should I proceed, or discontinue. He has alfter all this time now disclosed the fee note and did incur the fees he claimed for services of a lawyer in Nigeria. Or should I go to the appeal and state what happened?
