My neighbours large, old Ash tree fell across my wooden

Customer Question

My neighbours large, old Ash tree fell across my wooden garage and damaged it and my car beyond repair. I had him advised previously of its state and he was unconcerned. Since he has cut and pollarded all other trees on his property. my car was 13 years old but in immaculate condition body work and had only 35,000 miles on the clock. I rarely did more than 2,000 miles a years. I am recently widowed, age 80 and have had to spend half my savings on a replacement car, leaving me with only £5,000 . I have just been told that the scrap value of my car is £800/£900. I am well out of pocket. The old car would have lasted me another five years at least. I am the innocent party in all this and could well have done without the upset. Although the garage, fence, gate and path are to be repaired on my Home Insurance I feel very aggrieved of the lost of my meagre savings on having to buy a new car without any compensation from my very rich business neighbour. Can you advise. Would a claim against him be feasible? Philip Waite
