Customer Question

I was arrested for common assult after i accused my wife of having an affair and asked to see her phone. she handed me her phone and when I clicked on it, she tried to grab it back and we struggled over the phone. She ended up in a something like a headlock position for about 5 to 20 seconds and I immediately let go of her when I realised that things were escalating out of control. She called the police and said I put her in a headlock. I accepted she was in that position put stated I was acting in self defence and the actual headlock was accidental. My wife called the police to drop the charges but the police appear reluctant. I'm currently on bail.
Assistant: Thank you. Can you provide any more details to help us find you the right Expert?

has she written a statement against you?

I'm not sure as I can't contact her under my bail conditions. Maybe, this happened on Thursday

My recollection is that the so called headlock position was no more than 5 to 15 or so seconds. My wife told the police 1 minute.
The headlock was not deliberate. My wife had a very baggy dressing gown on which masked the true position of her body. When I felt the position transpire due to the grappling for the phone I let her go as soon as my brain had processed what was going on.
I told the police this was self-defence as my wife was wrestling me to get the phone otherwise there would have been no contact. I think my wife said that she gave it to me, I gave it back and then I tried to take it again.
I explained to the police that my wife and I are going through a divorce and I believe she has exaggerated the situation to get me out the flat. Her goal for the last 3 months has been to get me to move out the family home and she was frustrated that I wouldn’t just move out straight away. I wanted to start the mediation first.
I spoke to and met my father in law, who contacted me on Sunday. He said that he accepts I am a good person and explained that my wife had called the police because she panicked. That she would drop the charges and that she wanted my assurance I would not return to the flat. We had a pre-arranged mediation meeting for this Friday and he has re-iterated that new rules will be sorted out then.
So, I’m worried my wife has decided to play the situation but has now lost control and I’m going to end up in court.

Ok. Has she done this before?

Customer: replied 1 year ago.
I have a history of self harm. She has called the police before when we have argued and I have either harmed or intended to harm myself over last 15 years. We have never had any physical contact whatsoever in this regard before. I have never made any threats or shown any intent to ever harm her.

I've been self harming since age of about 8. So, this was something known to my wife before we married.

Obviously she finds it very scary so hence the habbit of calling the police.

Please don't spend any more time on this. The police have informed me that the matter will not be pursued further.Thank you for looking to scope and a response. With Regards.
