Good morning,,I was on a cruise recently and I subsequently found out that the Captain had a severe health problem, that is he had a heart attack. Can a claim be made against the cruise company for putting passengers at risk? There was on board a Staff Captain who was a licenced Captain. No incidents occurred, no one was hurt and no property lost.
I am just looking for legal advice.

No, I am afraid not.

If there was no incident there is no claim.

Creating a risk alone is not claimable in English law.

In any event, having a heart attack does not create a risk. Even if the Captain became unwell or even died the ship could be sailed safely by others.

This just isn't a health and safety issue or any issue really.
