04/09 we took over a cleaning contract 3 people were TUPE'd over to us, the process taking place correctly. Two of these staff have been abusive in language on a number of occasions and 7 days in they walked out using very colourful language. We took this to be their resignations; they are now claiming they didn't and that they were driven to it by the mismanagement of the process. We have investigated and obtained statements from all concerned. They were certainly doing their very best to undermine the smooth transition and frequent outbursts of vulgar hostility towards our management team, taking frequent breaks when warned not too. We are considering considering that during the investigation they are effectively suspended on full pay, but now the investigation has concluded firing them for their behaviour. How do we stand on this?
