Hi My husband has been charged with GBH section 18... He's pleaded quilty to section 20 but the cps what to charge him with section 18 intent... He's been in prison for over 5 months on section 18 what is it he's likely to get in years its his first offence

This person he hit is a friend lives with us a argument broke out... And my husband lashed out

He didn't mean to strike just to scare him but the friend grabbed the axe which caught his hand and he got a cut 7cm long which ended in hospital

My husband has never been in trouble any crime this is his first offence he 50 ywars of age

On the face of it then he should be pleading not guilty. His argument is that he didn't mean to cause GBH.

He can't plead not guilty to S20 of course but to S18.

if he is convicted then it is impossible to say. I don't have enough information here. Probably it will fall into the middle sentencing bracket which would lead to a starting point of 6 years and a range of 4-8.

If it is a S20 then it is much lower.

Yes, serve half minus time on remand.

Then be released and serve remaining half in the community.

Yes, between 4 -8 presuming it falls into the middle bracket.
