I have paid a fine under prostitution { public places} Scotland act 2007 s1{3}. fine £120. enforcement order under criminal procedure Scotland act 1995 section 226b. how long does this stay on police records.

Thanks for your question. I am a solicitor in Scotland. A criminal conviction stays on record indefinitely. However the conviction becomes spent after 12 months from the date of conviction and need not be disclosed on job applications except in certain applications where the law says you must disclose it, such as working with children or vulnerable adults for example. starting up local lottery. applying through council to have this registered as classed as small lottery. they refer to police if you have any relevant offences. I have looked at relevant offences schedule and not sure what this covers

The relevant offences are covered in Schedule 7 of the Gambling Act 2005 which is online. Prostitution doesn’t appear on the list.
