After a road traffic accident. Car hits girl who ran out in front of car. No blame attached to driver. An out of court settlement would cost the driver for his insurance policy, by increasing the premiums and loss of no claims bonus. Can the settlement be disputed.

Thanks for your question. If there is no blame attached to the driver, why is the insurance company settling out of court? Is this an “economic” settlement?

It is currently with the insurance company and a claim may have been lodged ?. Would they settle out of court or decline the claim.

if there is any prospect the claimant being successful they would look at a settlement. If there is not, then they should decline the claim.
