Help with MCOL Claim
JA: Where is this? It matters because laws vary by location.
Customer: London, UK
JA: What steps have been taken so far?
Customer: Submitted LBA, no response to solve the dispute, raised MCOL, received defence to MCAL and now I need to to Direction Questionnaire - Fast Track and Multi-track, and need help with that
JA: Anything else you want the Lawyer to know before I connect you?
Customer: The case in regards ***** ***** and works supplied not being of good quality and not according to the contract.

Hello my name is ***** ***** I will help you. I am just reviewing your question. This is an email service so there may be delays when responding.

What part are you stuck on?
What is the value of your claim?

Customer: replied 7 months ago.
the claim value is a bit over £13k, let me send you the documents, but I am stack on the Direction Questionnaire as I am not sure what is better to choose, fast track / multi-track and with the other options in the form.
Customer: replied 7 months ago.
Attached is the direction Questionnaire and other documents that may help with the context
Customer: replied 7 months ago.
Please let me know should you need any more detail to advise, thank you.

It’s fast track as that’s between £10k-£25k.

Is that all you want to ask me?

Customer: replied 7 months ago.
No, I wanted to ask how to fill the form attached in the second half of the Track pdf document
Customer: replied 7 months ago.
also - what is the difference between fast trance and multi-track, apart of value claimed? Is there any difference in the fee itself?

Fast track £545, multi £1090. You need cost budgeting and a multi day trial for multi track. What part you stuck on?

Customer: replied 7 months ago.
I believe I have already paid £545 when submitting the MCOL claim, so to my understanding - there should be no more charges, is that correct?

No, forget that.

The issue fee is different from a hearing fee.

You pay MCOL to issue the claim.

You then pay another fee to have it heard.

So yes, there will be further charges.

Can I clarify anything for you about this today please?

Customer: replied 7 months ago.
As per the form: (A) Settlement, I was told that it's better to try and settle the claim before which is favourably viewed by the court - I have already contacted the defendant and waiting if they will reply with something reasonable. Under 2. If yes, do you want a one month stay? What does it mean and is it better to tick it or not?

Yes, stay for a month

Does that calrify?

Customer: replied 7 months ago.
For B - B1 (High Court only) or B2 Trial (all cases) - which one to choose?
Customer: replied 7 months ago.
C) Pre-action protocol asks me to exchange documents relevant the claim - what does it mean?
Customer: replied 7 months ago.
D1) applications - is this relevant or not?
Customer: replied 7 months ago.
D3) I believe this does not apply as for multi-track, please confirm

B2 - you need to put which Court you want it at

C - if you sent a warning letter saying pay up or Court then yes, otherwise no

D1 - no

D3 - blank

Does that clarify?

Customer: replied 7 months ago.
G) Estimation of the final hearing

G) I have no idea how long it will take. Depends on how many people are called.

5 witnesses for a day trial.

Does that clarify?

Customer: replied 7 months ago.
B2 - which one should I choose though, I do not understand the difference
Customer: replied 7 months ago.
C) I have sent Letter before Action

B2) I have no idea which Court you should pick. Ok - how about Carlisle.

C) Then you tick yes

Does that assist?

Customer: replied 7 months ago.
In regards ***** ***** - Costs, 1) is the case is subject to fixed cost - in which instance would that be?
Customer: replied 7 months ago.
last one - J info to help court make judgement to manage the claim, can use only the small box in the form or can I attach a longer document with timeline of the dispute and evidence?
Customer: replied 7 months ago.
That would be the last question and thank you.

H) RTA and Public Liability are fixed costs.

J) leave that blank

Does that clarify?

Customer: replied 7 months ago.
J) leave that blank - wouldn't it be beneficial if I add more info for the court, or reply to the defence comments?
Customer: replied 7 months ago.
D4. Disclosure of non-electronic documents (all cases) - what does this mean
Customer: replied 7 months ago.
If it's too many questions, I will happy to close this topic and open a new one

J) No. this is just for directions

D) Standard directions

Does that clarify?

Customer: replied 7 months ago.
D) I understand that I have to write "Standard Directions" but what does that mean for me

The Judge will give standards directions setting the case down for trial.

Does that clarify?

Customer: replied 7 months ago.
Ok, so so will be communicated these at later stage?

Will what be communicated?

Customer: replied 7 months ago.
You said the judge will give the standards directions
Customer: replied 7 months ago.
When, how, in what form
Customer: replied 7 months ago.
I have never went trough any legal issue or case before, so these terms are completely new to me, and if I would not pay tons of money for terribly bad quality products provided, I would not go through this road, so my apologies for the silly questions.

By letter after allocation.
Does that clarify?

Customer: replied 7 months ago.
it does thank you
Customer: replied 7 months ago.
If I have any more question, I will raise them in a new claim.
Customer: replied 7 months ago.
