Ask a Law Question, Get an Answer ASAP!
Hi, I'm Lea and I have reviewed your query.
Are you stating that you, your wife and the children were habitually resident in France, but she brought there here to the UK without your consent?
Please bear in mind this is an email service and not a live chat so responses may not be instantaneous. I am not available for calls, but in all cases it is very likely you can be helped online.
In that case, your wife has abducted them, and that is the reason that your application to the UK courts has been rejected - the family court does not have jurisdiction to hear your case.
You need to contact the Central Authority in France for the Hague Convention on child abduction. You can find their contact details here: https://www.hcch.net/en/states/authorities/details3/?aid=90
Alternatively, as you are currently in the UK, you may wish to contact the English Central Authority here: https://www.hcch.net/en/states/authorities/details3/?aid=132 They may be able to assist you with your case from the UK - but you will need to contact them to find out first.
Does that clarify your position and what you need to do?
Can I check that you received my response and that it answered your question?
