Hello,my english language is very bad.I have signed contract with unionline Law firm.That contract informed my solicitor name and surname with overal responsibility and supervision of my case. my case now settlement agreement negotations.In page 4 form of authority signed my signature ,its my mistake,total didnt understen languages and process for my file handler.my solicitor never contact with my.only she file handler.settlement pack not discused with my.settlement pack not completely and not corectly.I totally panic...i do not agree to accept counter offers,i will not give instructions ,becouse im not happy ...my solisitor not contact with my. ,i am alone,completely alon.Its legal ?

Can you please clarify, if your claim has been settled in full? And your solicitor did not contact you before accepting the offer in full?

I note you mentioned stage 3, and settlement pack. These are terms which tell me it is an MOJ portal claim. So, it could be possible, any settlement at the moment, could be on an “interim” basis at stage 2. This is because stage 3 is to issue court proceedings for additional damages.

If you are unhappy with your solicitor, or the way your file has been dealt with, you can make a complaint to firms compliance officer. They are also called a COLP (Compliance Officer for Legal Practice). They will review your case to see if the person that dealt with your file has done so in a proper manner. If not, then you may be awarded compensation.

If you are unhappy with the outcome of the COLP investigation, you may then complain to the legal ombudsman about how your case has been handled. If they then find your case was not handled correctly, you will be awarded compensation for the professional negligence of the firm.

If you don’t agree, you don’t accept it. Your lawyers may then refuse to act for you if they feel it was a reasonable settlement because they wouldn’t issue proceedings over it. Then you would have to find a new firm. But if they do follow your instructions, reject the offer and issue, against their advice, the matter will go to court which is risky because there’s a chance you may receive less.
But if you are disagreeing with the settlement because of an error on the medical report, you would need an addendum report to rectify that so the injury can be re-evaluated.
