I am on bail until the 28th Feb starting I cannot return to

This answer was rated:

I am on bail until the 28th Feb starting I cannot return to my home address. It is 28days since being bailed tomorrow. Can I go home after the 28days. Thanks
JA: Where are you? It matters because laws vary by location.
Customer: United Kingdom
JA: What steps have you taken so far?
Customer: In what sense sorry
JA: Anything else you want the Lawyer to know before I connect you?
Customer: The witness has dropped the case and didn’t want to press charges. The CPS are still making a decision as to whether it needs to go to court again (granted bail at magistrates) and Cps haven’t even given my solicitor statements etc and court is on the 28th Feb because they’re still making a decision whether to drop the case

Thank you

The police will either charge you, re bail you or take no further action.

Until you are told your bail conditions are lifted or they are taking no further action, you can’t go back home.

I am sorry if this is not the answer you want, nor the one I want to give you, but I have a duty to be honest.

Can I clarify anything for you about this today please?

Thank you for your help. I appreciate your honesty. What is the point of the 28 day rule then that came into force with Amber Rudd the Home Secretary. Thank you

That can be extended by a senior officer.

Does that clarify?

Customer: replied 1 month ago.
So if it’s not extended tomorrow by a senior officer what happens? Because I have court on the 28th Feb and I’ve been on bail since the 20th Jan
Customer: replied 1 month ago.
Are you still there?

If it’s not extended it expires.

Does that clarify ?

Customer: replied 1 month ago.
So if it’s not extended tomorrow and it expires can I go home
Customer: replied 1 month ago.
And how will they notify me if it has been extended

yes.

Does that clarify?

Customer: replied 1 month ago.
How will they notify me if it gets extended

Phone I think.

Does that clarify?

Customer: replied 1 month ago.
Yes thank you. So can you please just confirm my understanding of this all.

I have been on bail since the 20th Jan until 28th Feb. The 28days for bail will expire tomorrow, if I am not contacted by the senior officer to extend my bail until my court date on the 28th Feb, the bail expires and I can go home?

Sorry. Just for piece of mind can you confirm my understanding is correct

Confirmed.

Does that clarify?
