Hi Jamie,So in November 2019 I was pulled over by the police and subsequently arrested for driving with no licence or insurance

Ok.

They have put the same charge twice. I have just spoken to the officer who advised that it was a mistake and it should be 1 for no license 1 for no insurance and they will reissue. Are they able to do this ?

Yes they can just amend the charge.

They can even wait until Court and do it then.

Nothing stopping the Prosecutor from amending on the day, it happens all the time.

I am sorry if this is not the answer you want, nor the one I want to give you, but I have a duty to be honest

Can I clarify anything for you about this today please?

Customer: replied 1 year ago.
Oh really wow
Customer: replied 1 year ago.

Customer: replied 1 year ago.

Customer: replied 1 year ago.
What Information do I put/ what is to be included
Customer: replied 1 year ago.
Also I have 2 professional references from employment to put forward do I attach these with my early plea ?

Yes, they can bring new charges on the day.

Yes, you can take the email to Court if you want.

Does that clarify?

Customer: replied 1 year ago.
If I am to put in a early plea based on the charges they have already given me I've been told that the judge can decide I do not need to attend court and if this is the case how will the charge then be amended ?
Customer: replied 1 year ago.
added

The matter would be relisted for a further hearing when you can put a plea to the amended charges

Does that clarify?

Customer: replied 1 year ago.
I'm trying to avoid going to court.
Why I want to put in the early guilty plea
Customer: replied 1 year ago.
Oh reallyAhh man

Sure. You can do that, but they are entitled to add charges.

Does that clarify?

Customer: replied 1 year ago.
Okay- so you go about putting in my early plea. What is process ?
Customer: replied 1 year ago.
To go about***

You tick the form, you post it.

Or you might be able to do it online

Does that clarify?

Customer: replied 1 year ago.
I've not been given a form- can I get 1 online ?
Customer: replied 1 year ago.
Do I send in my 2 references and a statement with my plea.

Yes.

Does that help?

Customer: replied 1 year ago.
to I send my references in with my guilty plea or yes to I can get the form online ?

Send it with the guilty plea

Does that assist?

Customer: replied 1 year ago.
thanks
Customer: replied 1 year ago.
Just to clarify
Customer: replied 1 year ago.
I've since spoken to the arresting officer

Splendid.

Customer: replied 1 year ago.
Who said the files sent to the court have the correct charges
Customer: replied 1 year ago.
they are submitting a statement to say we have since spoken and they have advised me of the charges in case I was to deny knowledge at court

Ok. But you are sending a plea so it doesn't really matter

Does that assist?

Customer: replied 1 year ago.
I'm going to put in an early guilty plea. Do you know what sort of sentence these charges carry ?

Yes I do.

Customer: replied 1 year ago.
I'll just put in my plea to respond to the updated chargers as opposed to ones I have been given.

Yes. You will get points and a fine.

Does that clarify?

Customer: replied 1 year ago.
Oh another very important question
Customer: replied 1 year ago.
How much points up to for each charge and generally what sort of discount do they apply for early guilty pleas ?

You will get probably 3 points.

You get 33% discount on any fine.

Does that help?

Customer: replied 1 year ago.
I got my license in February this happened in November last year. As the offense were committed on an expired provisional and prior to getting a full UK licence will they transfer over. Or will I lose my license because I've gained too many points in my first 2 years ?

Transfer over. You only lose if you get 6 points.

does that clarify?

Customer: replied 1 year ago.
3 points for no insurance and 3 points for no license ? So 6 in totalYes very helpful thank you

Yes......

You will get demoted to provisional.

Does that clarify?

Customer: replied 1 year ago.
I'm likely to get 6 points- if I get 3 for each so i will lose it even though I committed the offense prior to getting my full license ?

Yes likely to get 6 points.

Does that clarify?

Customer: replied 1 year ago.
lose the license although the offenses were committed prior to getting the license?
Customer: replied 1 year ago.
that clarifies the points just would like clarity on the license and that will be all for now.

You dont lose the licence, you just get demoted to provisional and yes even though before the licence.

Does that clarify?
