hi there
JA: Hi. How can I help?
Customer: i have a question about tenancy agreements
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: We are 4 students who were going to live in this house. The landlord said send me the signed tenancy agreement about a week ago and we did so. However we started getting frustrated as he was being rude and certain circumstances which lead to me texting him that you can give the accommodation to someone else. After this he sends me the message saying he has signed the agreement. But I still do not have the signed agreement from his side as he has not emailed me.
JA: Where is the house located?
Customer: leeds would you like to see the tenancy agreement
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Yes, the agreement would have started on 1st july

Hello my name is ***** ***** I will help you. I am just reviewing your question. This is an email service so there may be delays when responding.

What is it you want to know about this today please?

Customer: replied 1 year ago.
i want to cancel the tenancy agreement if it is valid. Is it valid since I have not got it signed from him. I backed out by texting him before he texted me that he has signed it

If you have not signed it then its not binding.

Its only binding if ALL parties have signed.

If anyone has not signed, its not binding

Can I clarify anything for you about this today please?

Customer: replied 1 year ago.
We all signed it and sent it to his email

But then we changed our mind before the landlord signed it
Customer: replied 1 year ago.
now the landlord just texts me he signed it after i said we don't want it anymore

Ok - if you emailed and withdrew BEFORE signed, its not binding

Does that clarify?

Customer: replied 1 year ago.
i have proof of texts that i withdrew before he signed
does that mean it is not legally binding
Customer: replied 1 year ago.
he had the contract filled in with our signs and then i messaged him (to withdraw) and then he messages me he has signed it
Customer: replied 1 year ago.
eventhough he probably has the contract signed from both sides, because i withdrew before he signed it as can be seen in our chat history, does that definitely make it non legally binding

It has been more than an hour now, please can you answer my question. It is really important

Forgive me I was having dinner.

If ALL parties have not signed ANYONE can withdraw.

Does that clarify?

Customer: replied 1 year ago.
No problem. I still do not fully understand. The landlord has a fully signed contract from all parties.
But like I said, I sent him the contract signed by tenants only and not by him, and then I withdrew by messaging him and then he tells me he has signed it

Yes, as I have said and I will repeat:
Unless ALL parties (including Landlord has signed) then its not binding.

If you signed and told him you wanted to cancel BEFORE he signed, its not binding

Does that clarify?
