I was wrongly accused of damaging a car by a car club

Hi, I was wrongly accused of damaging a car by a car club company. I now have a CCJ against me for £12000. I was not responsible for any damage and would like to know if I have any legal recourse?

Is the CCJ a judgment in default for not responding to the Claim form?

There is legal recourse to fight the claim.

In order to do this you will have to take steps to set-aside the judgment by making an application to the court.

The application will explain why you did not respond to the Claim form within the set deadline date and why you have a case to defend the claim against you.

Once you have completed the application called N244 you will need to pay the relevant fee which is £255. Then send a copy of the application to the court and your opponent The court will then review your application with a view of approving, listing it for hearing or dismissing it.

I must warn you that if the application is dismissed you run the risk of paying extra money towards the claim. Therefore think carefully on whether to dispute the claim
