Hi, I'm Lea
I am sorry to hear of your dilemma. You state that you have a house together which you have sold - have you received any of the funds from this?
Have you already split up?
The following is useful info to assist you with the site:
Is he intending to give you a share?
Firstly, as the property was in his name, you're not entitled to any of it. So if he chooses not to give you anything, there isn't anything you can do about it - for yourself. In relation to your children, you could make a Schedule 1 Children Act 1989 claim against the property/funds as the children will need to be rehoused.
You are entitled to claim child maintenance from him - you can either agree this between yourselves, or you can apply to the Child Maintenance Service - see here: https://childmaintenanceservice.direct.gov.uk/onlinerevive/public/contact-us-client
You can calculate likely entitlement here, but it only goes up to a certain income level - anything above that CMS cannot deal with and you may need to make a Schedule 1 application as per the property above. https://www.gov.uk/calculate-child-maintenance
You're very welcome.
I hope that things work out well for you.
