could you please confirm if this re-scheduling of the wedding to Feb 2021, was mutually agreed between you and the venue?
Right, as the re-scheduled date was agreed by both the parties, now venue need to see if the wedding can safely go ahead or not, before refunding the full amount.
As the doctrine of frustration would be applicable here, as the contract is not possible to complete , thus has frustrated. Discharging both parties of their contractual obligations, and returning any consideration ( money) taken for the performance of the contract.
No, as the date is yet to come so can not say if the contract has been frustrated or not.
If instead of re-scheduling the date, in May 2020 you would have asked for full refund , then the venue would have to give it to you as they could not have completed their part of the contractual obligation,
Yes, or you could have cancelled in May , have gotten your full refund , and then decide when to re-book , rather than re-scheduling on their given dates.
If the contract can not be performed in Feb 2021, ask for your money back.
