We needed our chimney and roof repairing, we checked adds , and reviews .the man came out and quoted us , he came back 14 days later and asked us if we wanted to go ahead ,he was best price so we said yes , he requested £550 for the seperate scafolding company, then £260 up front for him to carry out the repairs, with £200 to pay when finished to our satisfaction .He gave us bank account details to TRANSFER the money,, it didn't Ping? So we called Barclays and they gave no concerns or reasons why there was an issue ,or a possible RED Flag against this Trader? Barclays told us to ask the trader for another Account number? He gave us one and it Pinged. We then went and confirmed in an email what work we had agreed too and what we expected and emailed it to his business email. (He never replied to it?) Infact we never heard or saw him ever again, aparently the account we transferd into while barclays were still on the line? Was the trades man's " Guir friends personal bank account" .we have since found out the trades mans busines was being struck off Company House because he failed to file accounts .clearly he knew his business was being Dissolved..we believe it has now officially been disolved and his Web page has disappeared off Google. We have now heard on face book 6 or more other people have paid for roof repairs and if he has done some of it he does a runner leaving them with half a roof over their heads ,( Rogue Trader). As the money never went to his dissolved business can it be pursued against him as Ex Director or his girl friend as Recipient of our money, what chance of a refund would we have with Barclays Bank ? WHERE DO WE STAND .

Customer: we know he and his guilfriend registered the business at a privately land lord rented residential property and they have absconded leaving landlord debts, we also know where/ Area they have moved too, WISBECH , Cambridgeshire , about 15 miles away from us.

I just wonderd as the money never went to the business , but was sent to a private individual, are they possible culpable in law ,

Yes, they are. However you paid is liable.

You need to write a letter, set out your losses and request a refund within 14 days or say you will go to Court. This is called a pre-action protocol letter of claim. You should make sure you send this signed delivery and keep a copy. You must give 14 days warning before going to Court.

If they do not refund you then you can issue proceedings in the County Court. You can either do this online at: www.moneyclaim.gov.uk or by completing form N1 https://www.gov.uk/government/publications/form-n1-claim-form-cpr-part-7 and take it to your local County Court.

The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.

If the claim is for £10,000 or less it will be a small claim so you will not need legal representation. Over this value, you would need representation for trial.
