Can you confirm for me how long the original non-mol and occupation orders were made for please?
In terms of the divorce, have you submitted an application to court and have you applied for a financial remedy order yet?

OK, the first form you need is the FL403 - to extend the non-mol and occupation orders.

There's no cost for that application.
The transfer of a tenancy is an adjustment of property order, and this falls under a financial remedy that is associated with divorce.
As you have the non-mol in place, you don't need to go to mediation before applying to court.
You'll need to tick the mediation exemption on the form.
It's the form A - you'll see on the form at page 2 the options and you want to tick adjustment of property. The tenancy is considered marital property you see.

There is a cost for this application, of £275, but if you cannot afford that you may qualify for a fee reduction or remission.
