Customer: I have just left my rental flat and told to pay for cleaning having left the flat in a good condition. Lived for 3years. Not paying me my full deposit

  1. I am sorry to read of the above. May I confirm if the landlord carried out an inventory when you moved in and another one when you moved out please?
  2. have you been told that you need to pay for professional cleaning or have you been told that certain items are not cleaned to an appropriate standard and the landlord is seeking to charge you for cleaning as a result?
  3. do you consider that objectively you left the property in at least as good estate in terms of cleaning as the condition you found it?

Your question for number 2, yes I have been asked to pay for the cost of professional carpet cleaning

The agent took picture to compare; said one area is clean than the other , also mentioned limescale around taps though I have cleaned this also

To continue with texts please, the agent took pictures of the carpet and compare with other parts, stated not cleaned enough. Also took pictures of sinks stated some limescale despite my cleaning these earlier

Following the introduction of the tenant fees act, it is no longer possible for a landlord or agent to request that a tenant pays for professional cleaning. it is possible for a landlord to require that a property is cleaned to a professional standard by way of a provision in the tenancy agreement. Otherwise, a landlord can require that a tenant returns the property in the same condition that they found it except for wear and tear.

as such, this is in effect a dispute as regards ***** ***** the property was left in. The only basis for the landlord to make a claim is if they can prove on the balance of probability that the property was not left in the same condition of cleanliness as it was provided to you. The burden of proof is upon the landlord in this respect to show not for you to disprove and only of the landlord is able to produce evidence in support of their claims do you then need to address that evidence in dispute it.

If the landlord cannot show that the property was left in a less clean state than that which it was provided, then they will have no claim against you. To the extent that they are able to show this by way of an inventory for example, then they can make a claim for such reasonable costs as appropriate to bring the property up to that standard.

If you are not able to agree between you, you can either refer the matter to the free dispute resolution service offered by the deposit protection service or otherwise, you can elect to go to court.
