You mention AOL and Apple Id, but these are two different things.
How exactly are you creating the Apple ID?

apple have confirmed my id and password ***** will let me sign in but cant download any apps without billing information

Ok, do you see the option when selecting payment type as None, if its there its to the very right of the payment types.

there is no none in billing info

ok, they are forcing this on you Phillip, you are going to have to use a credit card to verify the account, then you can remove it after doing it.
You need to ask a friend or relative for this, and enter in the credit card.
Then once its verified, you use these instructions to remove it from the account
But they wont let you past this until you do sorry, its one of Apples stringent requirements.

i have used my wifes credit card and apple has updated my info and every thing seems to be working fine
i have changed billing info on your link and changed it to none as it did appear this time.

i would like to thank you for all your help richard and hope i dont get any more probs.
