If the builders come along with diggers etc. on our lane, have you any suggestions about what we can do? Would we be within the law to stop them?

Thanks for getting back in touch.

The problem you have is that as you do not legally own the lane, you have no right to stop a third party using it and carrying out works on it.

Although the Builders would be guilty of trespass, which is a criminal and civil offence, there is no-one with legal authority available to take action to stop them, as the true owner of the lane is not about.
The only other option would be the Police, but they will turn round and say they do not want to get involved as it is "a civil matter".
