, a neighbour has built a fence on his side of the existing

This answer was rated:

Hi, a neighbour has built a fence on his side of the existing fence. The existing fence is his back fence and is our 'side fence' Does this now mean that the existing fence is now ours to upkeep, or is it still his property? He built the fence over ten years ago, but has recently become a problem as its falling down.
Thank you,
Alex Watts : Hello Carol my name is ***** ***** I will help you with this.
Alex Watts : So I am clear, the neighbour installed the old fence and the new fence?

Hi Alex, no, the fence is the original boundary fence installed by the builders of our properties. The neighbour has built another fence on his side of this one.

Alex Watts : Ok. Is the current old fence one which the neighbour had responsibility ?

Alex Watts : Ok. Then it remains his, he should therefore upkeep it.
Alex Watts : It will not and never becomes your responsibility
Alex Watts : Can I clarify anything for you about this today please?

thank you for your help.
