I have a hearing on 31 January 18. How can I adjourn without incurring Costs?

What track is it on and why do you want to adjourn?

I am not happy with my current Solicitors and I am in the process to change my Solicitors. The case is on multi truck and the hearing is at county court central London .

You need to do it asap. If it is adjourned you can ask for costs in the case. But it needs to be quick.

If Counsel have already been instructed then you may be liable for a brief fee.

But you need to do this asap. The longer it is the more unlikely the Court will grant it and costs will be payable.

So make a formal application today using form n244:

If the other party does not agree to adjourn what the judge's order would be ?

No idea - it really depends on the Judge.

It is unhelpful you want to make it so close to the hearing. If you had more time a Judge would be more willing.

Can the judge refuse the adjournment if the other party does not agree to adjourn the case. What are the risks?

Yes of course the Judge can refuse. It is not a given.

The risk is the application is refused and you have to proceed.

It is up to you whether you keep your current ones or get new Solicitors asap.
