The flat above us has been sublet and the new tenants have caused 5 leaks since they moved in. The last 2 instances are from their carelessness, not plumbing issues. They are unapologetic and offered no recompense. What legal recourse is there to have them a) evicted and b) pay damages?

You can't evict the tenants, only the landlords can do that and you can't insist that they follow this or any other course of action.

You can sue the tenants for damages. You can raise the action in the small claim court of the sheriff court if the amount of your loss is £3000 or less.
