Can someone take civil action against you in Scotland if they suspect you of theft but do not have proof

Yes, anyone can take the civil action against another party where they have suffered loss as a result of a theft. The action would be for recovery of the money or other items stolen.

However the pursuing party has to prove his case on a balance of probabilities. If there is no evidence then he will have no case and the claim will fail.
