Hi There, Another question re my divorce action, the lawyers

This answer was rated:

Hi There,
Another question re my divorce action, the lawyers are having problems finding Nicola or a next of kin to serve the citation on, this is just a thought that came into my head, by law my children from my first marriage became Nicolas step children, could they be classed as next of kin for citation purposes, I know our son Ryan is to young, but my other children are adults and Nicola is their step mother, just a thought probably crazy, what is the legal position
Thank you for your question.
Doubtful, unless they were at some point treated as a child of the family.
The law says that "child" for this purpose is defined as:
"child ... in relation to
(a) the parties to a marriage, means
(i) a child of both of them; or
(ii) any other child, not being a child who is placed with them as foster parents by
a local authority or voluntary organisation, who has been treated by both of them
as a child of their family"
I hope this helps. Please leave a positive response so that I am credited for my time.
