In Scotland what procedure do I follow to gain a grant of probate for a Will in a Scottish Sheriff Court House?
Thank you for your question. I am a solicitor in Scotland.
You need to obtain a grant of Confirmation in Scotland, not probate.
You can get online form C1 and the guidelines for completing the form. You need to complete the form and estate inventory, the executor signs it and it is taken to the court along with the will which the executor has to docquet as being relative to the executor's declaration on the C1 form.
Before completing the estate form C1 the executor will have written to all fund and property holders advising of the death and asking for balances as at the date of death. The form can't be completed without that information.
A fee is payable to the court, and after processing the completed application the court will issue a certificate of Confirmation. That allows the executor to I gather and wind up the estate, transfer any property to the beneficiaries etc.
The sheriff clerk will give out a certain amount of advice to lay executors but a solicitor is recommended especially if there is a house involved.
