A friend of mine started divorce proceedings 4 years ago but her husband has left her struggling financially even though he has many assets. he seemed determined that she would not get any share of his assets. He has dragged his feet in complying with answers to her legal aid solicitor all the way until now with the court convening in April, His solicitor has come up with 5 pages almost slandering her. She had two boys and he had a one year old child and for 19 years she helped in a business that he started and he expected her to solely look after the children as well which she did. He offered her 5 thou and then upped it to 10 and to agree to accept this as a final settlement. He is living a lavish lifestyle has a large property and apparently has declared himself bankrupt and 2 million in debt. and indicating that she could be liable for some of the debt. He would have paid for a top lawyer to prepare his case. He is supposed to be bankrupt but has opened a restaurant is getting a swimming pool put in the house and treats some of the family and himself to australian holidays. My friend is so worn down she has no energy left to fight her case however I feel she should be able to speak in court to defend the lies he has potrayed in his lawyers defence statement of 5 pages, Would it jeopardise her agreeing to take the 10 thou settlement if she declares makes it clear that she cannot agree with some of this 5 page document which is includes lies about their marriage history it. I believe her husband has dragged his feet to give him time to manage to shift has assets around so amazingly to look like he is bankrupt the cse comes under Scottish law,,

Thank you for your question. I am a solicitor in Scotland. What evidence is there that he has been declared bankrupt? What is the justification for £10K settlement? If he has been made bankrupt where is the £10K coming from? What is your friend's own lawyer saying about this?
