I need to lodge an inital writ in court for a suspend and interdict action.Are you able to check my craves and pleas in laws, see if they make sense and are worded in such a way. I don't believe the Minute of Agreement to have been breached and is still valid (as I pay monthly payments towards the amount due).ThanksThe Pursuer respectfully ***** ***** Court:-1. To suspend a charge served by the Defender on the Pursuer on 14th November 2016 given on a Minute of Agreement signed on 26th April 2016 and diligence following thereon.2. To interdict the Defender to prevent her taking any further enforcement action against the Pursuer in relation to the Minute of Agreement.3. To grant interim interdict.4. To find the Defender liable to the Pursuer in the expense of this action.PLEAS IN LAW1. The Defenders claims that the Minute of Agreement has been breached are not valid, the said charge and diligence following thereon should be suspended as craved.2. The Defenders claims that the Minute of Agreement has been breached are not valid, interdict and interim interdict should be granted as craved.
