We purchased a property 13 years ago, and after all this time

Customer Question

We purchased a property 13 years ago, and after all this time we have been told we are a community and require an Administrator President cheque book etc. The plans submitted to the authorities all those years ago were for a community with central pool. None of this was built. Instead the builder sold and built individual Villa's on plots all but one with swimming pools. We have been informed our pools are illegal having no planning permission. Our Escritura's state Comunidad but no pools. None of the current residents where made aware, thus we were sold our properties under false pretences. The builders have said that plots 500 Sq meters plus are not deemed to be communities anything below by law is deemed to be a community Can you confirm this for me as all our plots are under the 500 sq mtrs.

Hi there

As your case there are a lot of them in Spain
Probably you will never get a licence for the pool, buy it it does exists for more than 5 years they can no force you to eliminate it

So, have clear than you got an ilegal pool, but you got it and you can not legalizate it
Thank you
