Hi
JA: Hi. How can I help?
Customer: I sold a property in the Netherlands in 2018 which I was cohabiting parttime with my then partner. Can I designate this as my PPR for CGT purposes?
JA: Have you talked to a lawyer about this? In which country do you live? If different, which country is your legal question related to?
Customer: its a tax question
JA: What steps have you taken so far?
Customer: I have sold the property
JA: Anything else you want the Lawyer to know before I connect you?
Customer: UK resident for tax purposes

Hello and thank you for allowing me to assist you.

Did you have another residence when this was purchased?

A nomination must be made within two years from the date on which the combination of residences changes. In a simple case where a person acquires a second home, a property must be nominated as the main residence within two years of the date on which the second property is acquired.

In the event that a person has more than one home and has not made a nomination as to which one is the main residence for CGT purposes, the one that counts as the main residence will be determined as a matter of fact. This will often be the property where the individual spends most of his time

That would be hard to prove as you already said part time

You are most welcome

A 5 star positive rating would be appreciated

Does the fact that I had a cohabitation agreement and rented out my UK residence help

It may

You would need to send a statement saying this was your main home
