I have just received an notice of intended prosecution. I

Hi, i have just received an notice of intended prosecution. I was doing 62mph in a 40mph area however the road is a 70mph area so confused. I did have 8 points earlier this year but 3 came off my licence in May and the remainder at start of November and concerned that these could still be used in court to provide a heavier sentence.

What was the date of this offence?

11 November 2017. The incident occured on the A90 at Burnshot Flyover and Cammo Road in Edinburgh.

3 points dropped off in May and remaining 5 points expired on 2 November.

In that case these points should not be an issue for you because they are removed from your licence and the court should not even see that they exist.

They will still show the DVLA but it doesn't aggravate your sentence anyway.
